Rental Agreement

JBR Boat Rentals, Inc. (hereafter referred to as Owner) rents to the above (hereafter referred to as Renter) in consideration of the following representations, covenants and agreements.

1. PLEASE NOTE THE JON BOATS DO NOT HAVE ADDITIOINAL SAFETY RAILS—YOU ASSUME RESPONSIBILITY FOR YOUR PASSENGER(S) SAFETY, INCLUDING CHILDREN. _____
2. Navigational Limitations:  The Renter agrees to restrict the operation of the boat to the following described are: 
3. The protected waters south of Gulf Harbor’s North Channel (Sand Bay), and North of Anclote River, East of Anclote Key, operation of vessel in the open Gulf of Mexico is strictly prohibited.

5. Renter declares that he/she is experienced and qualified properly to handle the above boat rental and will be the sole operator of the vessel.
6. If you were born on or after January 1, 1988 (i.e. 22 yrs in 2010), and you operate a motorboat with ten horsepower or more, you will be required to have a Florida Fish & Wildlife Conservation Commission (FWC) issued Boating Safety Education Identification Card.  You must successfully complete an approved boating safety course in order to receive the FWC Boating Safety Education ID card.  ___
7. The Renter verifies he/she is at least 21 years of age. ____
8. The Renter convents and agrees that the boat will be operated in a safe and careful manner and with due diligence and shall be returned with equipment and boat in same condition as when taken, ordinary wear and tear expected.
9. During the term of this agreement, the Renter shall be in full control of the rented boat and it is expressly understood that the Renter is not the agent, servant or employee of the Owner, in any way, whatsoever, and that the Owner is not responsible for injuries sustained by Renter, his guests and employees.
10. The boat shall be used exclusively as a pleasure vessel for the safe and proper use of the Renter, his family, guests or employees during the term of this agreement and shall not be used to transport merchandize, tow another vessel, nor passengers for hire or pay.
11. Owner herein assumes no responsibility for weather conditions which may arise or occur during the term of this agreement, and all rates and agreements will continue in full force and effect until the return of the boat to Owner.
12. The Renter further agrees:
13. To notify the Owner immediately of any accident involving the boat
14. On demand, to reimburse the Owner for the cost of all damages to the boat and equipment whether from accident, collision, theft,  loss or misuse or whatever, however.
15. To release the Owner and/or boat from any claim for loss and/or injury of any nature whatsoever, which may occur during the period of this rental.
16. To indemnify and save the Owner and/or boat harmless from any claim for liability for loss and/or injury to any other boat, property or persons, including all occupants of the boat hereby rented, by reason of accident involving the said boat during this rental or as a result of the operation of the boat in violation of any law or ordinance.
17. This contract constitutes the entire agreement by and between the parties hereto and no oral or implied agreement or understanding shall cancel or vary the terms of this contract unless reduced to writing and signed by the parties.
18. Consumption and possession of illegal drugs are prohibited by operator and guest of said vessel before or during operation of vessel.  Alcohol beverage is not condoned and operator is to remain sober and in full control of his/her faculties at all time.
19. Boat shall be returned by time agreed on or an hourly charge  for each additional hour or per 15 minutes will be due.
20. Renter/Operator agrees not to exceed maximum capacity of passengers/weight.
21. There will be a $450.00 plus gas and damages, for each boat, charged if it is necessary for Owner to tow boat back to marina, rescue boat or occupants if caused by poor judgment of the Renter.  ____________ (initialed by Renter)
22. Propellers, you damage it, you bought it.  Up to $275 for propeller plus related damages and any incurred fines.  Do not let lines drag in water—they may get caught in prop.
23. Violations of boating safety or violation of no wake zone will result in loss of deposit and a $50.00 fee and, Renter shall be held responsible for any damage to docks or boats caused by wake of vessel.
24. In regard to abandonment of vessel; Renter is responsible for any abandonment of vessel.  The vessel is not to be abandoned.  A jon boat has floatation and is supplied with personal floatation devices.  Signal for help or use your cell phone call Owner of your situation.
25. All vessels must be in channel no later than 30 minutes before sunset and shall not depart prior to sunrise.  All boats will be returned to the dock before dark.  No refunds for early return.
26. There will be a $35.00 cleaning charge for trash left on vessels or due to late returns.  ______ $20 charge for each cigarette burn ____
27.  No Grilling on the Boat unless renting the deck mounted Magma pedestal propane grill from JBR.  ___
28. No rafting or tying boats together for any reason.
29. If for any reason you find this boat unsatisfactory or you experience mechanical difficulty you will contact the Owner immediately.
30. Renters must have a working cell phone FULLY CHARGED.
31. Upon return, at Channel Marker 9 or entering the Gulf Harbors channel, Renter will call to notify the Owner of Return to Channel.  ______
