RENTAL AGREEMENT

*For any fees incurred for damages, late charges, rescue, unpaid gas, cleaning, safety violations, late charges that occur during the rental of this vessel.

Jon Boat Rentals, Inc. (hereafter referred to as Owner) rents to the above (hereafter referred to as Renter) in consideration of the following representations, covenants and agreements.

1. Navigational Limitations: The Renter agrees to restrict the operation of the boat to the following described are: a. The protected waters south of Gulf Harbor's North Channel (Sand Bay), and North of Anclote River, East of Anclote Key, operation of vessel in the open Gulf of Mexico is strictly prohibited. b. Declared Destination: ____________________

2. Renter declares that he/she is experienced and qualified properly to handle the above boat rental and will be the sole operator of the vessel. a. Those born after September 30, 1980 shall have passed a state approved boater's safety course.

3. The Renter convents and agrees that the boat will be operated in a safe and careful manner and with due diligence and shall be returned with equipment and boat in same condition as when taken, ordinary wear and tear expected.

4. During the term of this agreement, the Renter shall be in full control of the rented boat and it is expressly understood that the Renter is not the agent, servant or employee of the Owner, in any way, whatsoever, and that the Owner is not responsible for injuries sustained by Renter, his guests and employees.

5. The boat shall be used exclusively as a pleasure vessel for the safe and proper use of the Renter, his family, guests or employees during the term of this agreement and shall not be used to transport merchandize, tow another vessel, nor passengers for hire or pay.

6. Owner herein assumes no responsibility for weather conditions which may arise or occur during the term of this agreement, and all rates and agreements will continue in full force and effect until the return of the boat to Owner.

7. The Renter further agrees: a. To notify the Owner immediately of any accident involving the boat b. On demand, to reimburse the Owner for the cost of all damages to the boat and equipment resulting from accident, collision, theft or loss. c. To release the Owner and/or boat from any claim for loss and/or injury of any nature whatsoever, which may occur during the period of this rental. d. To indemnify and save the Owner and/or boat harmless from any claim for liability for loss and/or injury to any other boat, property or persons, including all occupants of the boat hereby rented, by reason of accident involving the said boat during this rental or as a result of the operation of the boat in violation of any law or ordinance.

8. This contract constitutes the entire agreement by and between the parties hereto and no oral or implied agreement or understanding shall cancel or vary the terms of this contract unless reduced to writing and signed by the parties.

9. Consumption of alcoholic beverages and/or drugs are prohibited by operator of said vessel before or during operation of vessel.

10. Boat shall be returned by time agreed on or an hourly charge of $35.00 for each additional hour or $10.00 per 15 minutes will be due.

11. Renter/Operator agrees not to exceed maximum capacity of passengers.

12. There will be a $450.00 plus gas and damages, for each boat, charged if it is necessary for Owner to tow boat back to marina, rescue boat or occupants if caused by poor judgment of the Renter. ____________ (initialed by Renter)

13. Propellers, you damage it, you bought it. $275 for propeller plus damages.

14. Violations of boating safety, abandonment of vessel, or violation of no wake zone will result in loss of deposit and a $50.00 fee and, Renter shall be held responsible for any damage to docks or boats caused by wake of vessel.

15. All vessels must be in channel no later than 30 minutes before sunset and shall not depart prior to sunrise. All boats will be returned to the dock before dark. No refunds for early return.

16. There will be a $20.00 cleaning charge for trash left on vessels. ______ $20 charge for each cigarette burn ____

17. No Grilling on the Boat. You must be 100 feet away from any open flame.

18. No rafting or tying boats together for any reason.

19. If for any reason you find this boat unsatisfactory or you experience mechanical difficulty you will contact the Owner immediately.

20. Renters must have a working cell phone.

21. Upon return, at Channel Marker 9, Renter will call to notify the Owner of Return to Channel. ______ Parties acknowledge that they have read the foregoing provisions all of which they are in complete understanding and agreement.

Additionally,

1. For any damages, rescue fee, unpaid gas, cleaning fee, safety violations, late charges, etc. that occur during the rental of this vessel, as listed on the Rental Contract.

2. I understand that I will be charged a minimum of $450 if the rental boat is beached.

3. No refunds for early returns.
